Lawsuit Filed Against State in Support of Mentally Disabled Kids

A lawsuit says Mississippi forces mentally ill children into restrictive psychiatric facilities when community-based programs would better serve their needs. 

The Mississippi Youth Justice Project, an advocacy group, filed the lawsuit Wednesday in U.S. District Court on behalf of three teenagers.  It also seeks class action status to include potentially hundreds of other Medicaid-eligible children with behavioral or emotional problems. 

The lawsuit seeks a declaration that Mississippi has unlawfully failed to comply with the Medicaid Act, the Americans with Disabilities Act and the Rehabilitation Act. 

Gov. Haley Barbour and other state officials are named as defendants in the lawsuit.
